Fubo TV’s Legal Victory Against Disney, Fox, and Warner Bros. Discovery: A Major Setback for Venu Sports Launch
In a major legal development, FuboTV has successfully fended off attempts by media giants Disney, Fox, and Warner Bros. Discovery to dismiss its antitrust lawsuit over the launch of Venu Sports, a new sports streaming service. U.S. District Judge Margaret M. Garnett has ruled that the case will move forward, and the trial is now scheduled for October 2025. This decision marks a significant moment in the ongoing battle between the streaming upstart and the corporate behemoths, highlighting the growing tensions in the sports broadcasting and streaming industry.
The lawsuit, filed by FuboTV earlier this year, alleges that Venu Sports, a proposed platform backed by Disney, Fox, and Warner Bros. Discovery, would create anticompetitive conditions in the sports streaming market. FuboTV claims that the streaming service, which plans to bundle key sports channels like ESPN, TNT, and Fox Sports, would harm competition by forcing consumers to pay for channels they don’t want in order to access popular sports content. This bundling practice is a central issue in the case, as Fubo argues it would increase costs for subscribers and hurt smaller competitors in the streaming space.

Judge Garnett's ruling is a significant blow to Disney, Fox, and Warner Bros. Discovery, who had hoped to have the case dismissed before it went to trial. The defendants had also sought to transfer the case to a California federal court, but that motion was also denied. This decision follows an earlier ruling in August, where the judge granted FuboTV’s request for a preliminary injunction, blocking the launch of Venu Sports due to concerns over antitrust violations. In her opinion, Garnett had noted that allowing the service to launch could lead to a "swift exodus" of Fubo's subscribers, potentially driving the company into bankruptcy.
The case now heads into the discovery phase, with both sides required to exchange evidence and prepare for trial. However, before the trial takes place, an appeals court will review the preliminary injunction. Disney, Fox, and Warner Bros. Discovery have appealed the injunction, and a hearing is scheduled for early January 2025. If the appeals court overturns the injunction, Venu Sports could proceed with its planned launch, which could have significant implications for the future of sports streaming. On the other hand, if the appeals court upholds the injunction, the case will continue toward trial, and Venu’s prospects of becoming a reality will be severely compromised.
The larger context of this legal battle involves a rapidly changing sports media landscape. In recent months, streaming platforms like Netflix have begun securing live sports rights, signaling a shift in how sports content is consumed. Meanwhile, Warner Bros. Discovery’s loss of NBA rights and other significant changes in broadcasting deals have only intensified the competition for sports streaming dominance. For FuboTV, this case is not just about preserving its business model; it is a fight for the future of independent sports streaming platforms.
Ultimately, the outcome of this lawsuit could have far-reaching consequences for the media industry. If Fubo succeeds, it could set a precedent for challenging anticompetitive practices in streaming services, while also signaling to media giants that the future of sports broadcasting may be more competitive than they anticipated.
