7-Eleven Hit With Nearly $1M Judgment After Ignoring Fair Settlement Offer

So, a woman named Chrystal Tommy from Smithers, British Columbia, was injured back in May 2018. She fractured her ankle and suffered further complications after tripping on a pothole in the parking lot of a 7-Eleven. This injury didn’t just cause her pain—it disrupted her entire life. She lost income, had ongoing health issues, and dealt with emotional trauma.
But here's the kicker—Chrystal didn’t rush straight to court looking for a massive payout. She actually tried to settle the matter reasonably. She made three different offers to 7-Eleven to settle out of court, with the first being just $125,000 plus her health care costs. That’s not a small amount, but compared to what came later, it was a bargain.

Fast forward to April 2025—Madam Justice Emily Burke of the BC Supreme Court issued her ruling. The court awarded Chrystal $907,363. That’s nearly seven times what she initially offered to settle for. And on top of that, the judge ordered 7-Eleven to pay double the court costs. Why? Because Chrystal’s settlement offers were fair, and if the company had accepted any of them, all of this could have been avoided.
Justice Burke made it clear that courts shouldn’t be burdened when reasonable offers are on the table. She emphasized that Chrystal was not only financially strained while waiting for her case to be heard, but that her offers should have been accepted.
