In a significant legal development, former President Donald Trump has scored a victory in his ongoing lawsuit against Iowa pollster J. Ann Selzer and The Des Moines Register. On Friday, the U.S. Court of Appeals for the 8th Circuit ruled in Trump’s favor, directing that the case be returned to Iowa State Court. This decision came after a federal judge, previously assigned to the case, was found to have overstepped their authority by keeping it in federal court.

Trump’s legal team had been pushing since May to have the lawsuit heard in Iowa State Court. The case centers on allegations that a final 2024 Iowa poll, conducted by Selzer and published by The Des Moines Register, deliberately misrepresented voter support, showing Vice President Kamala Harris leading Trump by three points just days before the election. The former president’s team claims the poll amounted to “brazen election interference,” suggesting it was intended to create the illusion that Harris had momentum in a critical swing state. Despite the poll, Trump won Iowa by over 13 points, marking a decisive victory.

The 8th Circuit’s opinion was sharply worded, granting a rare writ of mandamus, which allows higher courts to correct clear legal errors. With this ruling, the lawsuit can now be refiled in state court, as the case was dismissed “without prejudice,” opening the door for Trump’s claims to move forward in Iowa’s judicial system. A spokesperson for Trump’s legal team praised the ruling, stating that it ensures the case will be “litigated in Iowa State Court where it belongs” and that the defendants had previously tried to avoid state-level scrutiny.

On the other side, Selzer’s attorney, Bob Corn-Revere, emphasized that the ruling addressed only procedural matters and did not reflect the merits of the case. Similarly, Lark-Marie Antón, a spokesperson for Gannett, the parent company of The Des Moines Register, said the company continues to believe federal court is the proper venue, while expressing confidence that the case would be fairly adjudicated in state court.

This procedural win represents a critical step for Trump’s legal strategy, allowing him to continue pursuing his claims that the poll was an attempt to influence the outcome of the 2024 election. While the court has not ruled on whether the allegations are accurate, the decision to move the case back to Iowa State Court is being seen as a notable victory for the former president and his legal team.
