The GOP-led House Oversight Committee has now issued its final report, and it’s making some very strong claims. According to the committee, any pardons or commutations that were signed using Biden’s autopen should be considered “void.”

The report argues that Biden’s alleged “cognitive decline” might have prevented him from being fully aware of what he was approving. In a letter to Attorney General Pam Bondi, the committee urged her to take legal action and even consider prosecution of certain Biden aides who were involved in the clemency process. The 93-page report accuses the former administration of a “cover-up” of Biden’s mental health and claims there’s no solid record proving that Biden personally made all the executive decisions that bore his signature.

Republicans, however, aren’t backing down. They’ve asked the Justice Department to further investigate three top Biden aides who declined to testify, citing the Fifth Amendment. The committee also went a step further, writing to Washington D.C.’s medical board to question Biden’s former physician, Dr. Kevin O’Connor, for allegedly issuing misleading health reports.

Interestingly, the use of an autopen — basically a mechanical device that can reproduce a person’s signature — isn’t new in U.S. politics. It’s been used by previous presidents, and in 2005, the Justice Department even confirmed that its use is legal, as long as the decision itself came directly from the president. But the GOP’s report challenges that, arguing that in Biden’s case, the process lacked transparency and traceability — meaning there’s no solid paper trail linking his personal authorization to every signed action.

Biden’s team, of course, has pushed back hard. A spokesperson said these accusations are baseless and that Biden personally made every decision during his presidency. They’ve accused Republicans of chasing political retribution instead of focusing on reopening the government, which remains partly shut down.

In the end, this controversy isn’t just about a pen — it’s about presidential authority, credibility, and legacy. Whether these autopen pardons can legally be undone is unclear, since there’s no precedent for reversing a president’s clemency once it’s been granted. But what’s certain is that this issue is going to fuel political debate for a long time to come.
