Key Changes to the EU Settlement Scheme for Pre-settled Status Holders
The UK’s EU Settlement Scheme (EUSS) continues to evolve, offering smoother transitions for those affected by post-Brexit immigration rules. Significant changes are being introduced, particularly aimed at those who hold pre-settled status. These changes will make it easier for these individuals to transition to settled status automatically, without having to make a new application. The Home Office has outlined a phased plan, expected to roll out throughout 2025.
Starting in January 2025, the Home Office will automatically extend the pre-settled status of eligible holders by five years as their initial status nears expiry. This extension is crucial as it ensures that people will not lose their rights simply due to a missed deadline. It also provides a seamless transition for individuals who have lived in the UK for an extended period but have not yet reached the five-year threshold required for settled status.

Once the status extension is granted, the Home Office will run automated checks against available government data to verify eligibility for settled status. If the checks are successful, individuals will automatically be granted settled status, and their digital status will be updated. This process is intended to reduce the administrative burden on both individuals and the Home Office, ensuring that people can continue to live and work in the UK without disruption.
In cases where the Home Office cannot verify eligibility automatically, affected individuals will be contacted directly with further instructions on how to proceed. These updates will be phased in, with more pre-settled status holders being converted to settled status later in the year.
Additionally, for those who have lost their pre-settled status due to not meeting the continuous residence requirement, the Home Office is considering what steps to take next. As part of the ongoing evaluation, stakeholders will be invited to provide feedback on the process.
The Home Office has worked extensively to ensure that everyone who is eligible for settled status can obtain it as quickly and easily as possible. Employers and landlords are encouraged to stay informed to prevent discrimination against those with pending applications. Those who have been granted status under the EU Settlement Scheme can prove their status digitally using the View and Prove service, without needing a physical document.
