According to prosecutors, the dispute began when Barton made threatening comments about fighting his wife’s father and brother, escalating into a physical confrontation. The court heard how, after a verbal argument about family matters, Barton grabbed Georgia and forcefully pushed her to the floor. He then allegedly kicked her in the head, causing her to suffer a bleeding nose and a bump on her forehead. As a friend tried to intervene, Barton reportedly pushed him away and angrily warned him not to "disrespect me."

A distressed Georgia Barton called the police around 11:00 PM, reporting that her husband had hit her during the altercation. On the emergency call, she was heard telling the dispatcher tearfully that her husband had struck her and that she was now outside the house while he remained inside. When officers arrived at the scene shortly thereafter, Mrs. Barton detailed how she had been pushed and kicked and explained the context of the argument over family tensions.

The case against Joey Barton was initially delayed after Georgia Barton sent a letter retracting her statements. However, the prosecution appealed this decision, leading to the trial being reinstated. The former footballer, who has had a controversial career, denies the charge of assault by beating. His legal team has yet to provide a defense in court.
